(“Materials”) THAT iBeej Technology Solutions and Services AND/OR ITS SUBSIDIARIES OR AFFILIATES MAY MAKE AVAILABLE THROUGH THIS WEBSITE AND ANY SERVICES THAT ‘iBeej Technology Solutions and Services’ MAY PROVIDE THROUGH THIS WEBSITE or Related MOBILE APPLICATIONS (COLLECTIVELY “Services"). THIS WEBSITE, RELATED MOBILE APPLICATIONS, MATERIALS, AND SERVICES ARE COLLECTIVELY REFERRED TO IN THESE TERMS OF USE AS THE “QTRAQ Platform".

By accessing or using the QTRAQ Platform, registering an account, or by viewing, accessing, streaming, uploading or downloading any information or content from or to the Platform, you represent and warrant that you have read and understood, Agreed and accepted the Terms of Use, Privacy Policy, as well as Cookies Policy, will abide by them. If you do not agree or do not accept these Terms and condition, you are not authorized to use any of QTRAQ Services on website or an Android / IOS mobile application. You agree that you are solely responsible if you use services of QTRAQ for someone else through your account.

Use of QTRAQ Platform

iBeej Technology Solutions and Services authorizes you to use QTRAQ Platform or view and/or download Materials only for your own personal, non-commercial purposes. If you make copies of any of the Materials, you must retain on any such copies all copyright and other proprietary notices contained in the original Materials. Use of the QTRAQ Platform for any public or commercial purpose (including, without limitation, on another site or through a networked computer environment) is strictly prohibited. You may not modify, reproduce, publicly display, publicly perform, or otherwise distribute the Materials on this website. As between you and iBeej Technology Solutions and Services, iBeej owns the QTRAQ Platform. The QTRAQ Platform is protected under Indian and international copyright laws. Any unauthorized use of the QTRAQ Platform may violate copyright, trademark, and other national or international laws. When you use any of the Services provided by iBeej through the QTRAQ Platform, including but not limited to product reviews, seller reviews, booking appointments, you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such services, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use.

Please note that if you are a minor in the jurisdiction in which you reside, you must have the permission of, and be directly supervised by, your parent or legal guardian to use and/or access the QTRAQ Platform, and your parent or legal guardian must read and agree to the terms and conditions provided in this Terms of Use prior to your use and access to the QTRAQ Platform.

Charges

For QTRAQ platform, iBeej Technology Solutions and Services reserves the right to charge any fees or modify the policies from time to time. iBeej reserves the right, without any notice to you, to introduce new services and/or modify existing services along with fees. Introduction of fees or modification to any existing fees is effective immediately upon implementation/publication on the QTRAQ Platform.

In connection with your use of QTRAQ Platform, you may be subject to charges imposed by your broadband, wireless or other applicable carrier/internet service providers. Payment of such charges is solely your responsibility.

This website www..com ("Website") and its mobile application ("Application") are owned by iBEEJ Technology Solutions and Services ("iBeej"), a Proprietory firm incorporated under the laws of India,

QTRAQ (property of iBeej) aims to bring all primary stakeholders of the queue on one single platform providing LIVE access to variety of queues across different services in a single view.

QTRAQ's QRM system, with its loads of features, empowers businesses and professionals to digitalise and efficiently manage multiple queues at their premises as well as share Live Queue updates with their users in real-time. It creates a win-win situation, enabling both parties to effectively manage their appointment visits, as well as time and resources at their disposal. It is currently enabled for Doctors and Patients and is planned to be scaled-up to multiple businesses and professionals.

We advise to Users (patients) is to choose the Doctors that they are aware of and whose services they are comfortable with. Also, all patients will be able to view details of various doctors. And doctors will be able to share reports of patients via the QTRAQ platform for second round of opinion.

iBeej (or QTRAQ) is not responsible for

  • If Doctor do not arrive at the Dispensary / Clinic on time.
  • If the employees of the Doctors or clinic administration misbehave or exhibit rude behavior with the Patients or the people accompanying the Patients.
  • If certain aspects of the Doctor or clinic administration such as services are not as per the customer's expectations.
  • If the doctor or clinic administration cancels the appointments for reasons unknown.
  • If the baggage of a customer gets lost / stolen / damaged or accident of customer in the event of travel to doctor or clinic.
  • If the doctor or clinic administration changes a customer's appointment time at the last minute to accommodate a lady / infant / aged patient.
  • If the customer spends time waiting at the wrong clinic or doctor address.
  • If the doctor changes the appointment point.
  • QTRAQ (or iBeej) shall not be responsible and shall not be required to mediate or resolve any dispute or disagreement between User and Service provider ( Doctor).

The timings of appointments are as per the scheduled timings of clinic. However, the doctor or clinic administration may change the appointment timings or the appointments locations, or the doctor may get delayed due to unavoidable reasons such as traffic jams.

The patients are requested to check current status of their appointment to reconfirm their appointment time, on the date of their appointment.

The User hereby assumes the sole risk of appointment booking or making use or relying on the information relating to the Services available on this Website/ Application. QTRAQ platform does not promote any doctors listed on the Website/ Application. It is User’s responsibility to check the details of the doctors listed on the Website/ Application at its sole discretion.

Your Use of the QTRAQ Website and Mobile Apps

You hereby represent and warrant that you are at least eighteen (18) years of age or above and are capable of entering, performing and adhering to these Usage Terms and that you agree to be bound by these Usage Terms. While individuals under the age of 18 may utilize/browse the Website/ Application, they shall do so only with the involvement, guidance and supervision of their parents and / or legal guardians, under such Parent /Legal guardian’s registered account.

In order to access and use certain sections and features of the QTRAQ platform and services offered, you must first register and create an account with QTRAQ. When you register to use the Platform, you will provide us with your personal details such as Name, Date of birth, Age, mobile number, State ,city, etc. and will choose a username and password for your account. You must ensure that the Mobile Number that you provide is, and remains, valid. Your Mobile number and any other information you choose to provide about yourself will be treated in accordance with our Privacy Policy.

You certify that the Content you provide on or through the QTRAQ Website and Apps is accurate and complete, to the best of your knowledge. You are solely responsible for maintaining the confidentiality and security of your account including username and password. QTRAQ (or iBeej) is not responsible for any losses arising out of the unauthorized use of your account. You agree that QTRAQ (or iBeej) does not have any responsibility if you lose or share access to your device.

We may, from time to time, release new tools and resources on the Website, release new versions of our Apps, or introduce other services and/or features for the Platform. Any new services and features will be subject to these Terms of Use as well as any additional terms of use that we may release for those specific services or features.

  • In connection with the QTRAQ platform (website or mobile applications), you will not:
    • Make available any Content through or in connection with the QTRAQ, that is or may be in violation of the content guidelines.
    • Make available through or in connection with QTRAQ platform, any virus, worm, Trojan horse, Easter egg, time bomb, spyware, or other computer code, file or program that is or is potentially harmful or invasive or intended to damage or hijack the operation of, or to monitor the use of, any hardware, software, or equipment.
    • Use QTRAQ platform for any commercial purpose, or for any purpose that is fraudulent or otherwise tortious or unlawful.
    • Harvest or collect information about users of the QTRAQ platform.
    • Interfere with or disrupt the operation of the QTRAQ platform or related systems, servers, or networks used to make the QTRAQ Website (or Mobile Apps) available, including by hacking or defacing any portion of the QTRAQ Website or Mobile Apps; or violate any requirement, procedure or policy of such servers or networks.
    • Restrict or inhibit any other person from using the QTRAQ Platform.
    • Reproduce, modify, adapt, translate, create derivative works of, sell, rent, lease, loan, timeshare, distribute, or otherwise exploit any portion of (or any use of) the QTRAQ platform, except as expressly authorized in these Terms of Use, without iBeej Technology Solutions and Services express prior written consent.
    • Reverse engineer, decompile, or disassemble any portion of the QTRAQ platform, except where such restriction is expressly prohibited by applicable law.
    • Remove any copyright, trademark, or other proprietary rights notice from the QTRAQ platform.
    • Frame or mirror any portion of the QTRAQ platform, or otherwise incorporate any portion of the QTRAQ platform into any product or service, unless you obtain ‘iBeej Technology Solutions and Services’, express prior written consent to do so.
    • Systematically download and store any Materials.
    • Use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, “scrape,” “data mine” or otherwise gather any Materials, or reproduce or circumvent the navigational structure or presentation of the QTRAQ, without iBeej’s express prior written consent.
    • Cause injury to any person or entity.
    • Violate any law, rule, or regulation, or these Terms of Use.
  • You will not use the QTRAQ platform or name, logo, or brand to (1) send any unsolicited or unauthorized Content, including advertising, promotional materials, email, junk mail, spam, or other form of solicitation; or (2) use any meta tags or other hidden text or metadata utilizing a QTRAQ / iBeej trademark, logo, URL, or product name without written consent from ‘iBeej Technology Solutions and Services’;
  • You will not attempt to do anything, or permit, encourage, assist, or allow any third party to do anything, prohibited in this Section, or attempt, permit, encourage, assist, or allow any other violation of these Terms of Use.

Technology limitations and modifications

We will make reasonable efforts to keep the QTRAQ platform and services operational. However, certain technical difficulties or maintenance may, from time to time, result in temporary interruptions. iBeej Technology Solutions and Services reserve the right, periodically and at any time, to modify or discontinue, temporarily or permanently, functions and features of the QTRAQ Platform & Services, with or without notice, all without liability to you for any interruption, modification, or discontinuation. You understand and agree that iBeej has no obligation to maintain, support, upgrade, or update the Service, or to provide all or any specific content through the Service.

Termination

‘iBeej Technology Solutions and Services’ may terminate, suspend, or modify your registration with, or access to, all or part of the QTRAQ Platform, without notice, at any time and for any reason. You may discontinue your participation in and access to the QTRAQ Platform at any time. If you breach any of these Terms of Use, your authorization to use the QTRAQ Platform automatically terminates and you must immediately destroy any downloaded or printed Materials and any copies thereof.
Upon such termination or discontinuance of this Terms of Use, your right to access and use the QTRAQ Platform will terminate immediately. You will remain liable for all amounts due under your user account up to and including the date of termination, if any. You agree that iBeej Technology Solutions and Services (or QTRAQ platform) will have no liability to you for any costs, expenses, losses, damages, or liabilities relating to such termination and that iBeej may delete your content and Contributions from its servers and databases upon such termination.

Cancellation by User

You may discontinue to use and request to cancel your User Account with QTRAQ platform at any time, in accordance with the instructions available on the website or mobile applications. The effective date and time for such cancellation shall be the date and time on which you have completed the cancellation process on the QTRAQ platform, and the effective date for cancellation of Paid Services shall be at the end of such Paid Services’ subscription period.
Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to Paid Services, such subscription will be discontinued only upon the expiration of the respective period for which you have already made payment. Please note that as the cancellation process may take a few days, in order to avoid the next automatic renewal and respective charge the cancellation request should be made at least fourteen (14) days prior to the expiration of the then-current service period.

Cancellation by iBeej

Failure to comply with any of the Terms of iBeej (or QTRAQ) and/or to pay any due Fee shall entitle ‘iBeej Technology Solutions and Services’ to suspend (until full payment is made) or cancel your User Account and User Platform (or certain features thereof), as well as the provision of any related QTRAQ platform services (e.g., Paid Services) or Third Party Services to you. iBeej may suspend your account in case of three cancellations if it is taken consecutive. After your first cancellation, if you meet the doctor once, the counter starts from zero.

Prohibited Content

You agree that you will not make available Content in connection with the QTRAQ platform that:

  • is false, fraudulent, inaccurate, or misleading;
  • contains your full name(s), or any other confidential personally identifiable information of yourself or others;
  • violates any local, state, federal, or international laws or is otherwise tortious;
  • is protected by or would infringe on the rights of others (including iBeej or QTRAQ), including any patent, copyright, trademark, trade secret, right of publicity or privacy, or any other proprietary right, without the express prior written consent of the applicable owner;
  • is obscene, indecent, pornographic, or otherwise objectionable;
  • is derogatory, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by ‘iBeej Technology Solutions and Services’ in its sole discretion;
  • victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability;
  • is violent or threatening, or promotes violence against, or actions that are threatening to, any individual or group;
  • contains advertisements, solicitations, or spam links to other web sites or individuals, without prior written permission from ‘iBeej Technology Solutions and Services’;
  • contains or relates to chain letters or pyramid schemes;
  • impersonates another business, person, or entity, including iBeej (or QTRAQ platform), its related entities, employees, and agents;
  • violates any policy posted on the QTRAQ platform; or

is intended to cause harm, damage, disable, or otherwise interfere with the QTRAQ platform or our partners.

Payments, Refund and cancellation

QTRAQ platform uses third party payment providers to receive payments from related parties. iBeej (and QTRAQ) takes utmost care to work with third party payment providers, but does not control their systems, processes, technology and work flows, hence cannot be held responsible for any fault at the end of payment providers.
By the use of any of the payment method/s available on the Website or mobile application by You, iBeej (or QTRAQ) shall not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you due to any of the following:

  • Lack of authorization for any transaction/s; or
  • Exceeding the preset limit mutually agreed by You and any bank/s; or
  • Any payment issues arising out of the transaction; or
  • Decline of transaction for any other reason/s.

Please note that:

  • Transactions, transaction price and all commercial terms governing the provision of services are bipartite contractual obligations between You and the doctor. QTRAQ (or iBeej) acts merely as a facilitator being an independent platform and at no point in time, enters into any direct /contractual arrangement with the customers with regard to the doctor services. Use of the payment Facility shall not render iBeej (or QTRAQ) liable or responsible for the non-delivery, non-receipt, non-payment, damage, breach of representations and warranties, or fraud as regards the services listed on the Website / Mobile Applications.
  • iBeej Technology Solutions and Services (and QTRAQ) is not responsible for delays or erroneous transaction execution or cancellation of appointment due to payment issues
  • You have specifically authorized the Website or its service providers to collect, process, facilitate and remit payments and/or the transaction price electronically. Your relationship with Website / Mobile Apps is on a principal to principal basis and by accepting these Terms You agree that Website / Mobile App is an independent contractor for all purposes, and does not have control of or liability for the products or services that are listed on the Website / Mobile App that are paid for by using the payment facility.
  • You understand, accept and agree that the payment facility provided through any third party on the Website is neither a banking nor financial service provided by iBeej (or QTRAQ), but is merely a facilitator providing an electronic, automated online electronic payment collection and remittance facility for the Transactions on the Website / Mobile App using the existing authorized banking infrastructure and credit card payment gateway networks. Further, by providing payment facility Website is neither acting as a trustee nor acting in a fiduciary capacity with respect to the transaction or the transaction price.

Any agreement between you and the issuer of your credit card, debit card, or other form of payment will continue to govern your use of such payment method on the QTRAQ platform. You agree that iBeej Technology Solutions and Services is not a party to any such agreement, nor is iBeej responsible for the content, accuracy, or unavailability of any method used for payment.

Cancellation and Refund

iBeej Technology Solutions and Services will have the decisive right in all matters concerning Cancellation and Refund. Any discounted or exempted amount cannot be claimed for refund.
In a credit card transaction; User must use your own credit card for which User has full right & authority to validly use such Credit Card for making payment to QTRAQ platform / iBeej services. QTRAQ platform (or iBeej) shall not be liable for any credit card fraud. The liability to use a card fraudulently will be on the User and the onus to 'prove otherwise' shall be exclusively on User.
iBeej Technology Solutions and Services may amend its Cancellation And Refund Policy from time to time for the QTRAQ platform. If we make any substantial changes in the way we use your personal information we will notify you by Notification or an announcement on the website / mobile apps.

THE QTRAQ PLATFORM IS PROVIDED “AS IS" AND “WITH ALL FAULTS" AND THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE QTRAQ PLATFORM IS WITH YOU. iBEEJ TECHNOLOGY SOLUTIONS and SERVICES EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, WITH RESPECT TO THE QTRAQ PLATFORM (INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED OR STATUTORY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, TITLE, AND NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS). WITHOUT LIMITING THE GENERALITY OF THE FOREGOING; iBEEJ MAKES NO WARRANTY THAT THE QTRAQ PLATFORM WILL MEET YOUR REQUIREMENTS OR THAT THE QTRAQ PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE OR THAT DEFECTS IN THE QTRAQ PLATFORM WILL BE CORRECTED. iBEEJ TECHNOLOGY SOLUTIONS AND SERVICES MAKES NO WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE QTRAQ PLATFORM OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE QTRAQ PLATFORM. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU THROUGH THE QTRAQ PLATFORM OR FROM iBEEJ TECHNOLOGY SOLUTIONS AND SERVICES, ITS PARENTS, SUBSIDIARIES, OR OTHER AFFILIATED COMPANIES, OR ITS OR THEIR SUPPLIERS (OR THE RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS OF ANY SUCH ENTITIES) (COLLECTIVELY, “iBEEJ PARTIES") SHALL CREATE ANY WARRANTY. iBEEJ TECHNOLOGY SOLUTIONS AND SERVICES DISCLAIMS ALL EQUITABLE INDEMNITIES.

iBeej (or QTRAQ platform) and its suppliers, Service providers and licensors may make available various Materials.  The Materials are for booking an appointment and informational purposes only, and errors may appear from time to time.  Before you act in reliance on any Materials, you should confirm any facts that are important to your decision.  The iBeej Entities make no warranty as to the reliability, accuracy, timeliness, usefulness, or completeness of any Materials. If you come across any error or notice something that does not look quite right on the QTRAQ platform, we would appreciate it if you let us know by contacting us at qtraq@ibeej.com. 

Impersonation or unauthorized access

  • You may not impersonate another person or entity, or misrepresent your affiliation with a person or entity when using the Services;
  • You may not use or attempt to use another’s account or personal information without authorization; and
  • You may not attempt to gain unauthorized access to the Services, or the computer systems or networks connected to the Services, through hacking password mining or any other means.

Links to third-party websites

Links on the QTRAQ Platform to third-party websites are provided solely as a convenience to you. If you use these links, you will leave the QTRAQ Platform and go outside. QTRAQ platform (or iBeej) is not obligated to review such third-party websites, does not control such third-party websites, and is not responsible for any such third-party websites (or the products, services, or content available through the same). Thus, iBeej (or QTRAQ platform) does not endorse or make any representations about such third-party websites, any information, software, products, services, or materials found there or any results that may be obtained from using them. If you decide to access any of the third-party websites linked to from the QTRAQ Network, you do this entirely at your own risk.

Intellectual Property Rights
As between you and ‘iBeej Technology Solutions and Services’, all of the content included in and as a part of the QTRAQ Platform (including, without limitation, all Material, source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics, the “Content”), including all trademarks, service marks, and logos contained therein (“Marks”), including all know-how, trade secrets, inventions, goodwill and other intellectual property rights included in and as a part of the QTRAQ Platform (“IP”) is the property of, owned by or is licensed to ‘iBeej Technology Solutions and Services’, and are subject to copyright and other intellectual property rights under laws of India and foreign laws and international conventions. ‘iBeej Technology Solutions and Services’ reserves all rights in and to our website, Services, Content, IP and Marks.

Subject to your agreement to, compliance with, and except as otherwise prohibited by, this Terms of Use, you are hereby granted a limited, non-exclusive, non-transferable, non-sub-licensable, revocable, non-assignable and personal license to access and make personal and non-commercial use of this QTRAQ Platform; the license granted hereby does not include any resale or commercial use of the website, Services, Content, Marks and/or IP. If you download or print a copy of QTRAQ’s Content for personal use in accordance with the limited license granted herein, you must retain all copyright notices and other proprietary notices contained therein. You agree not to circumvent, disable or otherwise interfere with security related features of QTRAQ Platform or features that prevent or restrict use or copying of any of the Content, Marks and/or IP or enforce limitations on use thereof.
Despite any use of the terms “purchase,” “buy,” “sell,” “sale,” or similar terms, the components of the QTRAQ Platform are only licensed to you under this Terms of Use to the extent expressly provided herein, and not sold.

Limitation of Liability
IN NO EVENT WILL ANY OF THE iBEEJ PARTIES BE LIABLE FOR (A) ANY INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OR (B) ANY DAMAGES WHATSOEVER IN EXCESS OF INDIAN RUPEES ONE HUNDRED (INR 100) (INCLUDING, WIT

These Terms of Use, together with any additional terms to which you agree when using particular elements of the QTRAQ Platform, constitute the entire and exclusive and final statement of the agreement between you and ‘iBeej Technology Solutions and Services’ with respect to the subject matter hereof, superseding any prior agreements or negotiations between you and ‘iBeej Technology Solutions and Services’ with respect to such subject matter. iBeej Parties are third party beneficiaries with respect to the provisions in these Terms of Use that reference them. The failure of ‘iBeej Technology Solutions and Services’ to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, you nevertheless agree that the court should endeavor to give effect to the intentions of ‘iBeej Technology Solutions and Services’ and you as reflected in the provision, and that the other provisions of these Terms of Use remain in full force and effect. The Clause titles in these Terms of Use are for convenience only and have no legal or contractual effect. These Terms of Use shall remain in full force and effect notwithstanding any termination of your use of the QTRAQ Platform (of ‘iBeej Technology Solutions and Services’). These Terms of Use will be interpreted without application of any strict construction in favour of or against you or ‘iBeej Technology Solutions and Services’. These Terms of Use, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by ‘iBeej Technology Solutions and Services’ without restriction.


Modifications to these Terms of Use
